1. Scope

These General Terms and Conditions (GTC) apply to the use of the LEG-App of ecolabor GmbH. The LEG-App is a product and service of ecolabor GmbH for accompanying the establishment and management of Local Energy Communities (LEG) and virtual self-consumption associations (vZEV).

3. Service Description

The LEG-App offers the following services:

• Online registration for LEG projects
• Collection and management of interest registrations
• Management of building and system data
• Integration with distribution network operators (VNB)
• Visualization of network structures and load profile data
• Communication platform for LEG interested parties

4. Usage Requirements

4.1 Registration

Registration is required to use the LEG-App. You must provide truthful information and commit to keeping it current.

4.2 Minimum Age

The use of the LEG-App is intended for persons aged 18 and over. Minors can only use the app with the consent of their legal guardians.

4.3 Consent to Privacy Policy

The use of the LEG-App requires consent to the privacy policy. Without this consent, use is not possible.

5. Usage Rights

ecolabor GmbH grants you a non-exclusive, non-transferable and revocable right to use the LEG-App exclusively for the purposes described in these GTC.

6. Usage Prohibitions

It is prohibited:

• To use the LEG-App for illegal purposes
• To impair or manipulate the functionality of the app
• To gain unauthorized access to foreign data
• To spread malware or attack the app
• To use the app commercially without prior consent
• To violate copyrights or other rights of third parties

7. Liability

7.1 Liability of ecolabor GmbH

ecolabor GmbH is only liable for intent and gross negligence. Liability for slight negligence is excluded, insofar as this is legally permissible.

7.2 User Liability

You are liable for all damages that arise from intentional or negligent behavior when using the LEG-App.

7.3 Liability Exclusion

ecolabor GmbH does not guarantee uninterrupted availability of the LEG-App. The app is provided "as is".

8. Data Protection

The collection, processing and use of your personal data is carried out in accordance with the privacy policy of the LEG-App, which is part of these GTC.

9. Intellectual Property

All rights to the LEG-App, including copyrights, trademark rights and other intellectual property rights, remain with ecolabor GmbH or the respective rights holders.

10. Availability and Maintenance

ecolabor GmbH strives for high availability of the LEG-App, but cannot guarantee uninterrupted availability. Maintenance work may lead to temporary outages.

11. Changes to the GTC

ecolabor GmbH reserves the right to change these GTC at any time. Changes will be communicated to users in a timely manner. Continued use of the app after notification of changes is considered consent to the changed GTC.

12. Termination

You can end the use of the LEG-App at any time by deleting your account. ecolabor GmbH can terminate the use immediately in case of violations of these GTC.

13. Final Provisions

13.1 Applicable Law

These GTC are subject to Swiss law. The place of jurisdiction is Basel-Landschaft, Switzerland.

13.2 Partial Invalidity

If individual provisions of these GTC are invalid, the rest of the GTC remain valid. The invalid provision will be replaced by a valid provision that comes closest to the economic purpose.

13.3 Severability Clause

If individual provisions of these terms and conditions are or become invalid, the rest of the terms and conditions remain valid. The invalid provision will be replaced by a valid provision that comes closest to the economic purpose.
